Global Civil Society Launches Manifesto for Ethical AI

NEW DELHI, India, Dec 6 2023 (IPS) – We, a global coalition of over 50 civil society and human rights organizations from over 30 countries have co-developed the “Civil Society Manifesto for Ethical AI”, a groundbreaking initiative aiming to steer AI policies towards safeguarding rights and deconolonising AI discourse. We question, and we are not the only ones: whose voices, ideas and values matter in AI ?


“If Silicon Valley was a country it would probably be the richest in the world. So how genuinely committed is Big Tech and AI to funding and fostering human rights over profits? The barebones truth is that if democracy was profitable, human rights lawyers and defenders including techtivists from civil society organizations wouldn’t be sitting around multistakeholder engagement tables demanding accountability from Big Tech and AI. How invested are they in real social impact centred on rights despite glaring evidence to the contrary?,” asks Nina Sangma, of the Asia Indigenous Peoples Pact, a regional organization founded in 1992 by Indigenous Peoples’ movements with over 40 members across 14 countries in the Asia-Pacific region.

We are currently at a critical juncture where most countries lack a comprehensive AI policy or regulatory framework. The sudden reliance on AI and other digital technologies has introduced new – and often “invisible” – vulnerabilities, and we have just seen the tip of the iceberg, literally melting from the effects of climate change.

Some things we have already seen though: AI is still a product of historical data representing inequities and inequalities. A study analyzing 100+ AI-generated images using Midjourney’s diffusion models revealed consistent biases, including depicting older men for specialized jobs, binary gender representations, featuring urban settings regardless of location, and generating images predominantly reinforcing “ageism, sexism and classism”, with a bias toward a Western perspective.

Data sources continue to be “toxic”. AI tools learn from vast amounts of training data, often consisting of billions of inputs scraped from the internet. This data risks to perpetuate harmful stereotypes and often contains toxic content like pornography, misogyny, violence, and bigotry. Furthermore, researchers found bias in up to 38.6% of ‘facts’ used by AI.

Despite increased awareness, the discourse surrounding AI, like the technology itself, has predominantly been shaped by “Western, whiteness, and wealth”. The discrimination that we see today is the result of a cocktail of “things gone wrong” – ranging from discriminatory hiring practices based on gender and race, to the prevalence of algorithms biases.

“Biases are not a coincidence. Artificial intelligence is a machine that draws conclusions from data based on statistical models, therefore, the first thing it eliminates is variations. And in the social sphere that means not giving visibility to the margins,” declares Judith Membrives i Llorens, head of digital policies at Lafede.cat – Organitzacions per la Justícia Global.

“AI development isn’t the sole concern here. The real issue stems from keeping citizens in the dark, restricting civic freedoms and the prevalence of polarisation and prejudice on several dimensions of our societies. This results in unequal access, prevalent discrimination, and a lack of transparency in technological processes and beyond. Despite acknowledging the potential and power of these technologies, it is clear that many are still excluded and left at the margins due to systemic flaws. Without addressing this, the global development of AI and other emerging technologies won’t be inclusive. Failure to act now and to create spaces of discussion for new visions to emerge, will mean these technologies continue to reflect and exacerbate these disparities,” says Mavalow Christelle Kalhoule, civil society leader in Burkina Faso and across the Sahel region, and Chair of the global civil society network Forus.

The Civil Society Manifesto for Ethical AI asks, what are the potential pitfalls of using current AI systems to inform future decisions, particularly in terms of reinforcing prevailing disparities?

Today, as EU policymakers are expected to close a political agreement for the AI Act, we ask, do international standards for regulating machine learning include the voice of the people? With the Manifesto we explore, challenge, disrupt, and reimagine the underlying assumptions within this discourse but also to broaden the discussion to incorporate communities beyond the traditional “experts.” Nothing about us, without us.

“We want Artificial Intelligence, but created by and for everyone, not only for a few,” adds Judith Membrives i Llorens.

From the “Internet of Cows” to the impact of AI on workers’ rights and on civic space, developed by over 50 civil society organisations, the Manifesto includes 17 case studies on their experiences, visions and stories around AI. With each story, we want to weave a different path to build new visions on AI systems that expand rather than restrict freedoms worldwide.

“The current development of AI is by no means an inevitable path. It is shaped by Big Tech companies because we let them. It is time for the civil society to stand up for their data rights,” says Camilla Lohenoja, of SASK, the workers’ rights organisation of the trade unions of Finland.

“Focusing on ethical and transparent technology also means giving equal attention to the fairness and inclusivity of its design and decision-making processes. The integrity of AI is shaped as much by its development as by its application,” says Hanna Pishchyk of the youth group Digital Grassroots.

Ultimately, the Manifesto aims to trigger a global – and not just sectorial and Western-dominated dialogue – on AI development and application.

Civil society is here not just as a mere token in multistakeholder spaces, we bring forward what others often dismiss, and we actively participate worldwide in shaping a technological future that embraces inclusivity, accountability, and ethical advancements.

Hurricane Otis and the Indifference Toward the Children of Acapulco

ACAPULCO, Mexico, Nov 2 2023 (IPS) – Acapulco is a paradise. A port of golden sunsets, toasted sand, and deep blue sea. Its dream beaches captivated the hearts of Elvis Presley and Elizabeth Taylor. US President John F. Kennedy chose its shores to spend his honeymoon with Jackie Kennedy. Its luxury hotels and the untamed sea made it the most famous tourist destination in Mexico.

Today, Acapulco is devastated. A Category 5 hurricane—the deadliest possible rating—called “Otis” hit the beach on October 25 with incomparable force. No one anticipated it. Hours before it made landfall, it was just an inconvenient storm. Suddenly it became a deadly cyclone. Most of the hotels are destroyed, the sea swallowed people, houses were blown away, and dozens of people are dead.

In the last century, its beauty attracted the world’s most influential celebrities. Its tranquil mornings and lively nightlife attracted actresses, singers, politicians, aristocratic musicians, and families who wanted to spend their summers by the sea. I myself spent my youth at the family timeshare apartment in Acapulco, and it was there that I met my husband Alejandro, with whom I’ve been married for 40 years. My life is permanently connected to Acapulco.

Luxury businessmen, millionaire athletes, and Michelin-starred chefs arrived. Also drug dealers, money launderers, and men looking for girls and boys to rape in exchange for food or a few dollars for their parents who lived in the city’s poor areas.

Because there are two Acapulcos. They both share an airport and roads, so all roads lead to that pair of versions of the same city. There is a “diamond Acapulco” where the rich vacation with all the amenities at their disposal. And there is a “traditional Acapulco,” where the poor live who work for wealthy tourists.

The people who inhabit “diamond Acapulco” and “traditional Acapulco” do not usually cross paths. They live in the same city, but they are separated by golf courses and exclusive shopping malls. Only rich foreigners and wealthy nationals cross to the poor side when they feel a repugnant urge: to make their plans for child sex tourism a reality with girls and boys as young as 3 years old.

Acapulco is one of the most unequal tourist destinations in the world. In Mexico, it is the most unequal municipality of all: more than 60% of its 900,000 inhabitants live in extreme poverty, which means they do not know what they will eat today or tomorrow. They are the workers who serve plates of fresh seafood, who sweep marble floors, who fill the wine glasses of tourists.

For years, journalists and human rights organizations have told horrific stories that combine poverty, inequality, and sex tourism: a 6-year-old boy rented out to be photographed naked in exchange for milk and eggs; a 9-year-old girl sold to a Canadian tourist to be his wife for a month; homeless teenagers invited to sex parties on lavish yachts in exchange for food; parents and mothers waiting outside hotels for their children to be raped for a price paid in dollars per hour.

Those pedophiles and child molesters turned Acapulco into the country’s primary destination for child sexual tourism. They also led Mexico to the disgraceful second position in the production of child pornography, only surpassed by Thailand, according to data from the Mexican Chamber of Deputies and the United Nations Children’s Fund.

Today, Acapulco is a different place. Little remains of the port that enchanted singers Agustín Lara and Luis Miguel. There are thousands of poor families without homes, hundreds of workers who lost their jobs, and dozens of fishermen without boats to go out to sea to find sustenance. The destruction is so extensive that complete economic recovery is estimated to take decades, not years.

Under these conditions, childhood is at very high risk. Many families have lost so much that their bodies are the only currency they have left. And in the dirty business of forced prostitution, child bodies are the most sought after.

Amid this unprecedented crisis in Mexico, the Chamber of Deputies approved amendments to the general law against human trafficking. These changes aim to broaden the scope of the law enacted in 2012 and update it to address new technologies that traffickers and organized crime engaged in sexual exploitation can use. The wording has some issues that we are still analyzing, but it also includes positive aspects.

For example, it introduces new protections for individuals with injuries, intellectual disabilities, and Afro-Mexican towns and communities. The latter represent 6.5% of the total population in Guerrero and 4% of the residents in Acapulco, according to the National Population Council.

Civil society organizations are monitoring these changes and hope that the deputies will honor their commitment to protecting the victims.

Meanwhile, it is the responsibility of all, not just in Mexico, to help Acapulco back on its feet, a place that has given so much to both nationals and foreigners. It won’t be easy or quick, but every day we delay puts the vulnerable children at risk due to the magnitude of sexual tourism in that beautiful port.

After Hurricane Otis, Acapulco will be different. Its reconstruction is an opportunity to build a new city on the ruins of depravity, one with values and respect for human dignity. I long for the day to see it standing and for its coastline, beach, and air to remain a paradise, especially for children like me who grew up happily by the sea.

Halfway to 2030: Our 5 Asks at the SDG Summit

NEW YORK, Sep 15 2023 (IPS) – At the UN SDG Summit in New York, the Forus global civil society network is calling for decisive action on SDG implementation. Clearly, as we hit the midpoint towards the “finish line” of the Agenda 2030, progress is stagnating.


The 2023 Special Edition of the SDG Progress Report emphasized that we’re falling short in implementing the SDGs. In April this year, UN Secretary General Antonio Guterres deplored that “Progress on more than 50 per cent of targets of the SDGs is weak and insufficient; on 30 per cent, it has stalled or gone into reverse,” disproportionately impacting the world’s poorest and most vulnerable.

As we approach the halfway mark of the 2030 Agenda, we urge world leaders at the UN General Assembly to address the precarious state of SDG implementation. Here’s our 5 asks.

Walk the talk with clear implementation plans and benchmarks for the realization of the Sustainable Development Goals.

“In Guatemala, there are two worlds, one for a small group that benefits from this macroeconomic stability, this weakness of democracy, this co-optation of state institutions, and a large majority of the population that faces poverty and inequality,” says Alejandro Aguirre Batres, Executive Director of CONGCOOP, the national platform of NGOs in Guatemala that recently published an alternative report on the implementation of the SDGs in the country.

Governments must make specific national implementation plans to advance the Sustainable Development Goals, with clear benchmarks on when to achieve the targets set in 2015. Following the SDG Summit, we call on the United Nations and its partners to ensure that the “National Commitments to SDG Transformation” called for by the Secretary-General are adequately compiled and tracked, including by providing a transparent and inclusive platform for showcasing these commitments, helping to ensure adequate implementation, follow-up and accountability. All efforts and commitments must focus on breaching the increassing gap in inequalities, healing polarisation and restoring socio-environmental rights at the core of Agenda 2030 implementation as no form of development should come at the cost of environmental degradation and injustice.

Presenting a viewpoint from Asia, Jyotsna Mohan Singh, representing the Asia Development Alliance, emphasizes that while the SDGs look good on paper, their real-world implementation remains far from satisfactory. She explains, “Governments should develop a policy coherence for sustainable development roadmap with timebound targets,” adding that it’s all about creating spaces grounded in equity where civil society and other stakeholders can join discussions and connect with local communities.

In regions like the Sahel, stretching 5,000 kilometers below the Sahara Desert from the Atlantic to the Red Sea, challenges like conflict, political instability, extreme poverty, and food insecurity affect nearly 26 million people. Yet, this region is teeming with opportunities, boasting abundant resources and a young population, including 50% young women and girls. As civil society leader Mavalow Christelle Kalhoule, Forus Chair and President of SPONG, the Burkina Faso NGO network, puts it, “What unfolds in the Sahel and in so many other forgotten communities ripples across the globe, impacting us all even if we choose to look away. Implementing the Sustainable Development Goals is vital to unlock a different future. But for global change to truly happen, we need countries to come together, we need solidarity, horizontal spaces, and for world leaders to start listening and acting accordingly.”

Commit to the protection of civic space and human rights.

“Although the state of Pakistan has ratified many global instruments, including the International Covenant on Civil and Political Rights and the SDGs, the irony is that none of them have been transformed into local policies and regulatory frameworks. Unfortunately, civil rights advocates and organizations have either transformed themselves into humanitarian organizations or practiced self-censorship to avoid state atrocities. Pakistan is failing to achieve SDGs due to disengagement with civil society and other stakeholders. Ironically, the government is unable to provide reliable data on any of their own priority indicators to measure progress towards the implementation of SDGs, particularly on rights-based indicators,” says Zia ur Rehman, National Convener of the Pakistan Development Alliance. Their newly published Pakistan Civic Space Monitor reveals a generally restricted civic space, including restraints on freedom of speech, assembly, information, rule of law, governance, and public participation, with further deterioration. This rings true for 92% of Forus members – comprising national and regional civil society networks in over 124 countries – who consider the protection of civic space and human rights a top priority.

Indeed, over the past decade, thousands of civil society organizations have faced increasing challenges due to restrictions on their formation and activities. Nine out of 10 people now live in countries where civil liberties are severely restricted, including freedoms of association, peaceful assembly, and expression, according to the CIVICUS Monitor. Forus reports confirm that civil society deals with increasing restrictions, involving extra-legal actions, misinformation and disinformation about their work both online and offline. Research also highlights the insufficiency of current institutional mechanisms to ensure an enabling environment for civil society, including addressing impunity for attacks on civil society and human right defenders, implementing supportive laws and regulations, and facilitating effective and inclusive policy dialogue. A recent ARTICLE 19 report highlights the inadequate integration of crucial elements like freedom of expression and access to information into SDGs, hampering progress. Journalist killings increased in 2022. Additionally, monitoring access to information mainly focuses on having a legal framework, ignoring its quality and adoption. Strengthening these rights is vital for advancing all SDGs. The growing number of human rights defenders being killed every year – at least 401 in 26 countries were murdered for their peaceful work in 2022 – is another worrying trend that needs to be reversed as the protection and promotion of human rights is the cornerstone of achieving sustainable development. Without human rights we will just move backwards.

Strengthen and Catalyze Robust Financing for the SDGs.

From the recent Summit for a new global financing pact to the Finance in Common initiative, it’s clear that the focus this year has been on increasing investment. But we need quality not just quantity, as expressed in a join civil society declaration aimed at public development banks signed by over 100 civil society organisations from 50+ countries. While we welcome UN Secretary General Antonio Guterres’s call for a SDG Stimulus, we remind Governments, International Financial Institutions, public development banks and donors that more efforts must be done to scale up investments for the realization of the SDGs at all levels, including through additional support for civil society and by involving communities in all “development talks”. The role of the private sector and financial institutions in the implementation of the 2030 Agenda must be talked about openly. It is important to include in all development projects being carried out specific budgets for actions linked to the implementation of the 2030 Agenda. Discussions about financial reforms that are being repeatedly undertaken by several countries cannot happen behind close doors and in non-inclusive forums such as the G7 and G20. Instead, they should be open, inclusive, and transparent, involving a broader spectrum of protagonists, including civil society, to ensure fairness and sustainability in shaping global financial policies.

“The SDGs are severely off track as we reach the critical half-way point of Agenda 2030. We need a renewed global ambition on financial commitments to make progress on the SDGs. Reforms of global financial architecture are a crucial part of this to ensure we have a fairer, more effective, inclusive and transparent system supporting lower-income countries that are at the forefront of the global climate, debt, poverty, food, and humanitarian crises. It’s not about a lack of finance, it is about political will and getting our priorities right,” says Sandra Martinsone, Policy Manager – Sustainable Economic Development at Bond UK.

Mobilize Transformative Commitments for SDG16+.

Recognizing the vital role of SDG16+ as a critical enabler for the entire 2030 Agenda, governments should come to the SDG Summit with targeted, integrated, focused and transformative commitments to accelerate action on SDG16+. As developed in the #SDG16Now collective campaign, this includes domestic policies and resources, legal reforms and initiatives to advance SDG16+ at the international, national and local levels, as well as ambitious global commitments to strengthen multilateralism and international resolve to promote peace, justice, the rule of law, inclusion and institution-building. Additionally, governments must use key moments – such as the 2024 High-Level Political Forum and the Summit of the Future – to advance implementation and delivery of the SDGs through similar commitments to action, and ensure adequate follow-up to these commitments going forward.

Ensure civil society participation and listen to communities, reinvigorate commitments to SDG17.

The 2030 Agenda overall cannot be achieved without building on the role of civil society and fostering a true global partnership. Every year at the fringes of the UN General Assembly, initiatives such as the Global People’s Assembly bring to the ears of world leaders the voices of communities historically marginalised. Governments need to reinvigorate engagement towards SDG17 to trengthen the means of implementing sustainable development goals and revitalising global partnerships for sustainable development. It’s high time we move away from conducting discussions about the future of development in closed-door settings. Tokenistic participation of civil society, where their involvement is merely symbolic or superficial, undermines the core principles of nclusivity, hurting genuine progress and meaningful collaboration. A more inclusive approach must be embraced that actively involves civil society and communities. Let’s #UNmute their voices and perspectives by bringing about reforms to current participation mechanisms, and giving them a real platform to be heard.

In 2015 every government in the world agreed as a global community on what we want for our comon future for people and planet. So many efforts and work went on to reach such an agreement. Now is the time for governments and world leaders to walk the walk and prioritize people and the planet, delivering the 2030 Agenda, essential to secure our shared future. It is time for world leaders to act decisively and uphold their commitments to the SDGs.

The UN’s Own Relevance Is at Stake at This Year’s General Assembly

NEW YORK, Sep 7 2023 (IPS) – This September, world leaders and public policy advocates from around the world will descend on New York for the UN General Assembly. Alongside conversations on peace and security, global development and climate change, progress – or the lack of it – on the Sustainable Development Goals (SDGs) is expected to take centre-stage. A major SDG Summit will be held on 18 and 19 September. The UN hopes that it will serve as a ‘rallying cry to recharge momentum for world leaders to come together to reflect on where we stand and resolve to do more’. But are the world’s leaders in a mood to uphold the UN’s purpose, and can the UN’s leadership rise to the occasion by resolutely addressing destructive behaviours?


Sadly, the world is facing an acute crisis of leadership. In far too many countries authoritarian leaders have seized power through a combination of populist political discourse, outright repression and military coups. Our findings on the CIVICUS Monitor – a participatory research platform that measures civic freedoms in every country – show that 85% of the world’s population live in places where serious attacks on basic fundamental freedoms to organise, speak out and protest are taking place. Respect for these freedoms is essential so that people and civil society organisations can have a say in inclusive decision making.

UN undermined

The UN Charter begins with the words, ‘We the Peoples’ and a resolve to save future generations from the scourge of war. Its ideals, such as respect for human rights and the dignity of every person, are being eroded by powerful states that have introduced slippery concepts such as ‘cultural relativism’ and ‘development with national characteristics’. The consensus to seek solutions to global challenges through the UN appears to be at breaking point. As we speak hostilities are raging in Ukraine, Sudan, the Occupied Palestinian Territories and the Sahel region even as millions of people reel from the negative consequences of protracted conflicts and oppression in Afghanistan, Ethiopia, Myanmar, Syria and Yemen, to name a few.

Article 1 of the UN Charter underscores the UN’s role in harmonising the actions of nations towards the attainment of common ends, including in relation to solving international problems of an economic, social, cultural or humanitarian character, and to promote respect for human rights and fundamental freedoms for all. But in a time of eye-watering inequality within and between countries, big economic decisions affecting people and the planet are not being made collectively at the UN but by the G20 group of the world’s biggest economies, whose leaders are meeting prior to the UN General Assembly to make economic decisions with ramifications for all countries.

Economic and development cooperation policies for a large chunk of the globe are also determined through the Organisation for Economic Cooperation and Development (OECD). Established in 1961, the OECD comprises 38 countries with a stated commitment to democratic values and market-based economics. Civil society has worked hard to get the OECD to take action on issues such as fair taxation, social protection and civic space.

More recently, the BRICS – Brazil, Russia, India, China and South Africa – grouping of countries that together account for 40 per cent of the world’s population and a quarter of the globe’s GDP are seeking to emerge as a counterweight to the OECD. However, concerns remain about the values that bind this alliance. At its recent summit in South Africa six new members were admitted, four of which – Egypt, Iran, Saudi Arabia and the United Arab Emirates – are ruled by totalitarian governments with a history of repressing civil society voices. This comes on top of concerns that China and Russia are driving the BRICS agenda despite credible allegations that their governments have committed crimes against humanity.

The challenge before the UN’s leadership this September is to find ways to bring coherence and harmony to decisions being taken at the G20, OECD, BRICS and elsewhere to serve the best interests of excluded people around the globe. A focus on the SDGs by emphasising their universality and indivisibility can provide some hope.

SDGs off-track

The adoption of the SDGs in 2015 was a groundbreaking moment. The 17 ambitious SDGs and their 169 targets have been called the greatest ever human endeavour to create peaceful, just, equal and sustainable societies. The SDGs include promises to tackle inequality and corruption, promote women’s equality and empowerment, support inclusive and participatory governance, ensure sustainable consumption and production, usher in rule of law and catalyse effective partnerships for development.

But seven years on the SDGs are seriously off-track. The UN Secretary-General’s SDG progress report released this July laments that the promise to ‘leave no one behind’ is in peril. As many as 30 per cent of the targets are reported to have seen no progress or worse to have regressed below their 2015 baseline. The climate crisis, war in Ukraine, a weak global economy and the COVID-19 pandemic are cited as some of the reasons why progress is lacking.

UN Secretary-General Antonio Guterres is pushing for an SDG stimulus plan to scale up financing to the tune of US$500 billion. It remains to be seen how successful this would be given the self-interest being pursued by major powers that have the financial resources to contribute. Moreover, without civic participation and guarantees for enabled civil societies, there is a high probability that SDG stimulus funds could be misused by authoritarian governments to reinforce networks of patronage and to shore up repressive state apparatuses.

Also up for discussion at the UN General Assembly will be plans for a major Summit for the Future in 2024 to deliver the UN Secretary-General’s Our Common Agenda report, released in 2021. This proposes among other things the appointment of a UN Envoy for Future Generations, an upgrade of key UN institutions, digital cooperation across the board and boosting partnerships to drive access and inclusion at the UN. But with multilateralism stymied by hostility and divisions among big powers on the implementation of internationally agreed norms, achieving progress on this agenda implies a huge responsibility on the UN’s leadership to forge consensus while speaking truth to power and challenging damaging behaviours by states and their leaders.

The UN’s leadership have found its voice on the issue of climate change. Secretary-General Guterres has been remarkably candid about the negative impacts of the fossil fuel industry and its supporters. This July, he warned that ‘The era of global warming has ended; the era of global boiling has arrived’. Similar candour is required to call out the twin plagues of authoritarianism and populism which are causing immense suffering to people around the world while exacerbating conflict, inequality and climate change.

How Nigeria’s Legal System is Failing to Safeguard Widows’ Rights

In February this year, Chichi Okonkwo not only lost her husband but was stripped of everything they owned together. Her husband was severely injured in a car accident about a month earlier. Despite being rushed to a hospital in Enugu, where they resided, he succumbed to his injuries weeks later. To compound her grief, Okonkwo’s late husband’s male siblings forcibly entered her home in the city a few hours after his passing, confiscating her husband’s land documents, car, money, clothes, and marriage certificate.


In the wake of these heart-wrenching events, Okonkwo was left with nothing but her six children. The eldest is just 18.

“They took everything my husband and I owned and forcibly evicted me and my children from our home,” laments Okonkwo. “They heartlessly claimed that, as a widow, I had no rights to any of my late husband’s possessions.”

Okonkwo’s children are now out of school because she was a housewife who depended on her husband’s income and is now left with nothing. She revealed that her late husband’s siblings, who seized and were aware of his bank PIN, callously left her with a mere 1 000 naira (approximately USD 2) out of the 2 million naira ($2,600) he had in his account.

Okonkwo said her husband’s relatives swore to drag her to court to challenge her rights, but she cannot afford a lawyer due to her financial situation.

In Nigeria, there are around 15 million widows.

Unfortunately, widows in the country often face the denial of their basic human rights due to traditional and cultural practices rooted in patriarchal beliefs.

According to The World Bank, “In much of Africa, marriage is the sole basis for women’s access to social and economic rights, and these are lost upon divorce or widowhood.”

In a country like Nigeria, where men dominate the economic and political systems, women are often expected to be submissive. The challenges women face are particularly amplified when they become widows, creating a doubly marginalized subgroup. Moreover, this vulnerable position sometimes exposes widows to dehumanizing rituals and harmful practices.

These harmful practices include mourning rites that involve widows sleeping with their deceased husbands’ corpses, shaving of widows’ heads, seclusion, wearing black or white clothes, and being forced to sleep and sit on the floor or mat. Additionally, some widows are coerced into marrying other members of the deceased husband’s family.

Despite laws granting women the right to inherit their husbands’ assets, many widows can still not claim their rightful share of land and property.

Efforts to combat these practices, such as the Violence Against Persons Prohibition Act (VAPP) enacted in 2015, have faced challenges in implementation and adoption by all states. According to the law, offenders are subject to a 500,000 naira ($648) fine or two years in prison. But arrests and prosecution of offenders are rare. And gender-based violence has persisted, which includes violence towards widows.

The enforcement of laws against offenders has been hindered by religious and cultural norms that promote silence and suppression of victimization cases. Victims often face threats or pressure from family members, community, or religious leaders whenever they try to report incidents to law enforcement.

Like Okonkwo, Sarah Temidayo’s life took a tragic turn when she lost her husband of four years to lung cancer in 2019. However, her grief was compounded by the actions of her husband’s relatives, who invaded her home in Lagos mere hours after his passing, intent on claiming everything that belonged to him. They even went so far as to take her wedding gown, certificates, and her then-five-year-old daughter’s clothes. Devastated and without recourse, Temitope sought justice through the legal system, but her efforts have yielded no results.

“I did not pick a pin out of my house. I had to start my life all over again,” she says.

Unfortunately, the nightmare did not end there for Temidayo. She was subjected to constant threats from her husband’s mother, who continued to torment her and accuse her of killing her son through witchcraft. These threats escalated to a terrifying climax when assassins attacked her at a bus stop in March 2021. She managed to survive, albeit with six bullets lodged in her leg. Despite reporting the incident to the police, no investigation was conducted, leaving her feeling abandoned by the system meant to protect her.

According to Ifeoma Oguejiofor, a legal practitioner in Southeast Nigeria, widows face challenges in seeking justice due to the understaffed courts, which can cause delays in the resolution of cases. Additionally, the financial burden of hiring a lawyer becomes a significant obstacle for many widows, making it difficult to access proper legal representation to handle their cases.

“There is a significant difference between the laws written in books and the actual pursuit of justice. According to the law, a surviving spouse, whether in a traditional marriage, a long period of cohabitation, or a marriage registered under the act, is entitled to inherit the estate of their deceased spouse. However, achieving justice through the legal system is often a prolonged and costly process, particularly for widows who have already lost a substantial portion of their assets to their husband’s relatives,” she explains.

“It’s high time the government, traditional rulers, and religious clerics enforce laws to protect widows in Nigeria. No woman should be discriminated against because she lost her husband,” says Hope Nwakwesi, the founder of Almanah Hope Foundation, a non-governmental organization focused on supporting Nigerian widows.

Nwakwesi, a widow who lost her police husband in 1994, endured distressing cultural rites, including having her hair shaved and wearing a mourning dress for a year. She faced further hardships as her relatives forcibly took her property, and she was expelled from her workplace and home in the police barracks. Despite seeking help, many, including police officers who offered assistance, demanded sexual favors in return.

Now, Nwakwesi is advocating for a bill in Nigeria’s legislative chamber. The bill aims to eradicate repressive cultural practices against widows and safeguard their fundamental human rights.

“My goal is to get the bill I’m fighting for approved and signed into law by the Senate. The current Violence Against Persons Prohibition Law is too vague and lacks specific clauses for protecting the rights of widows. Once the new bill becomes law, those who discriminate against widows will face arrest and prosecution by law enforcement agencies,” says Nwakwesi.

Abiola Akiyode-Afolabi, a civil rights activist and founding director of Women Advocates Research and Documentation Centre, noted that “For the government to protect widows effectively, they should review and update existing laws related to widows’ rights to ensure they are comprehensive, enforceable, and in line with international human rights standards.”

“Merely having laws in place is not enough; the government must ensure their effective implementation at all levels of the justice system. This requires training and sensitizing law enforcement officials, judges, and legal practitioners on the rights of widows and the importance of protecting them,” she adds.
